4. La protezione dei civili nelle missioni delle Organizzazioni regionali
La POC, sebbene nata nel DIU e poi sviluppata in ambito ONU, ha preso
ovviamente piede anche nelle Organizzazioni regionali che l’hanno nel tempo
introdotta, studiata e sviluppata a partire dalla dottrina ONU.
Due in particolare c’interessano da vicino.

a. L’Unione Europea
Le missioni di pace UE trovano il primo fondamento giuridico nel Trattato
di Amsterdam che modifica l’art. J.7 (ora artt. 42 e 43) del trattato sull’Unione

Europea e sancisce formalmente la nascita della politica estera e di sicurezza

comune (PESC), avvia l’inglobamento dell’Unione europea occidentale (UEO)
e, infine, introduce la possibilità di condurre missioni umanitarie e di soccorso,
le attività di mantenimento della pace e le missioni di unità di combattimento
nella gestione di crisi, ivi comprese le missioni tese al ristabilimento della pace .
