10. IL DECRETO CAIVANO, DALLA LOTTA ALLA CRIMINALITÀ
MINORILE AL RECUPERO ANBIENTALE: L’ATTENZIONE AL

BINOMIO SOCIO – AMBIENTALE ALLA BASE DELLE NUOVE
MISURE ADOTTATE

La criminalità minorile sempre più dilagante e l’esigenza di offrire una più effettiva e consistente
tutela contro di essa, ha spinto il Governo e successivamente il Parlamento, in sede di conversione
del Decreto Legge n. 123 del 15/09/2023, a varare numerose nuove misure per fronteggiare
problematiche gravi ed urgenti quali, appunto, il disagio giovanile, la povertà educativa e la
criminalità minorile; tematiche così delicate che, come è chiaro, portano necessariamente al
confronto con questioni spinose e di non facile trattazione come le condizioni di povertà, il
reperimento delle risorse, la carenza di affettività o il contesto sociale e strutturale di
appartenenza e di crescita. Attraverso tale contributo, scevro di qualsiasi opinione soggettiva,
pertanto, si cercherà di offrire una panoramica completa ed esaustiva, ma al tempo stesso rapida
e concisa, delle maggiori modifiche apportate all’ordinamento penale da questa nuova
disposizione normativa.
Contestualmente, si accennerà anche alle operazioni di recupero ambientale cui è stato soggetto
il Comune di Caivano, operazioni previste indirettamente dal medesimo Decreto ma certamente
necessarie allo scopo di giungere ad un generale miglioramento dell’aspetto ambientale e
strutturale del comune. Tutto questo al fine di offrire spazi idonei ad uno sviluppo sano ed
armonico del minore ed evitare così il suo ingresso nella vita criminale, anche tramite la
commissione di reati gravissimi per l’ambiente.

The increasingly rampant juvenile crime and the need to offer more effective and consistent
protection against it, pushed the Government and subsequently the Parliament, when converting
Legislative Decree no. 123 of 09/15/2023, to launch numerous new measures to address serious
and urgent problems such as youth hardship, educational poverty and juvenile crime; such
delicate issues which, as is clear, necessarily lead to confrontation with thorny and difficult issues
such as conditions of poverty, finding resources, lack of affection or the social and structural
context of belonging and growth. Through this contribution, free of any subjective opinion, we
will therefore try to offer a complete and exhaustive, but at the same time rapid and concise,
overview of the major changes brought to the criminal law by this new regulatory provision.
At the same time, we will also mention the environmental recovery operations to which the
Municipality of Caivano was subjected, operations indirectly foreseen by the same Decree but
certainly necessary in order to achieve a general improvement in the environmental and
structural aspect of the municipality. All this in order to offer suitable spaces for the healthy and
