And it is precisely this need for unity government that determines the relevance of the
tasks. However, the body also affects, through its action on matters involving concurrent
competence between State and Regions, and then - in a sense - the border, borderline, as
the territorial government, civil protection, health protection and the 'power. The exami-
nation of constitutional jurisprudence in the areas in which the body shows that the
ground more frequent conflict brought to the attention of the Constitutional Court is the
dynamic relations between the State and the Regions, in which it is often called a delica-
te mediation and a complex balancing of constitutionally protected values. The task is
even more difficult because of the frequent interweaving of functions that are not always
on time-defined and distinct but rather - crisscrossing and overlapping each other - high-
light the delicate problem of determining the competent body from time to time. Ultima-
tely, the flexibility of the division of responsibilities outlined in the Constitution requires
a continuous and difficult "actio finium regundorum" from the View, inspired by a model
of regionalism, not so much "dual" as "cooperative", ie not characterized by a rigid divi-
sion of powers, but mechanisms of connection and coordination between the various levels
of government. The ultimate goal is to implement a synergy between the various levels of
government, state and regional, and thus what is commonly referred to as "multi-level
governance". And it is interesting to note that the Constitutional Court to resolve the
various conflicts brought to its attention on the environment based on the principle of sub-
sidiarity, which made its formal entry into our Constitution in Article 118, as introduced
by Constitutional Law October 18, 2001 No 3.

l Corpo forestale dello Stato svolge la propria attività prevalen-
temente in ambito statale ed in relazione ai compiti di rilevanza
Iche gli spettano in materia di ordine e sicurezza pubblica (arti-
colo 117, comma 2, lettera h), Cost.), di polizia giudiziaria (articolo
117, comma 2, lettera l), Cost.), di tutela dell’ambiente e dell’ecosi-
stema (articolo 117, comma 2, lettera s), Cost.), nonché di tutela del
paesaggio (articolo 9 Cost.). In queste materie il Corpo opera a sal-
vaguardia di interessi e valori primari, ed essenziali per la colletti-
vità, i quali, esigono una tutela unitaria, uniforme e coordinata sul ter-
ritorio nazionale. Ed è proprio quest’esigenza di unitarietà che
determina la rilevanza statale delle funzioni svolte.
Tuttavia il Corpo, con la sua azione, incide anche su materie che
sono oggetto di competenza concorrente tra Stato e Regioni
quindi, in un certo senso, di confine (borderline) come il governo
del territorio, la protezione civile, la tutela della salute e l’ali-
mentazione (articolo 117, comma 3, Cost.).
