a vocazione internazionale e in continua evoluzione e sviluppo, che
persegue la missione, a rilevanza costituzionale, di tutelare e salvaguardare
l’ambiente, le foreste e la filiera agroalimentare del Paese, ed è in grado di
fornire risposte sempre più efficaci e concrete, attraverso la specializzazione,
la territorialità e l’innovazione tecnologica.
The environment is a relevant and topical issue. It is included in the agendas of
international summits, international organisations, and national lawmakers.
Environment protection has become a ‘subject’ of public and constitutional law,
providing important principles for the implementation of regulatory and
jurisprudential functions.
The environment has entered into force the Italian regulations, both in
constitutional rank and in primary and secondary sources.
With the support of the Constitutional and Supreme Court, environmental
protection has become a constitutional value, even in the absence of explicit
references in the Constitution. This value is protected and transversal, first through
an extensive interpretation of the concept of landscape and the recognition of the
principle of ‘environmental healthiness’, connected to the other recognized rights,
until the constitutional reform of 2022, which included environmental protection
among the fundamental principles.
Italian environmental law consists of a multi-layered and multidisciplinary
legislation. In this context, it can be said there is a ‘functional primacy’, to the tasks
assigned by the law, to the Arma dei Carabinieri, which acts, in particular through
the Command of Units for Forestry, Environmental and Agri-food Protection.
This Command has high specialization, at the international level, and continuously
evolving. It pursues the mission, of constitutional relevance, of protecting the
environment, forests, and the agri-food chain. It can provide effective and concrete
responses, through specialization, territoriality, and technological innovation.
