had to be checked. It would be interesting to know just how many of these
requirements were ever checked. I believe that the approach today must be dif-
ferent. There must be a simplification from the top, with clear regulations and
it is essential to have organisms that operate well, controlling the territory
without overlapping areas of competence. Law n. 68/2015 is then inserted into
this framework, with its basic approach, entailing the severe punishment of cri-
mes which create permanent open wounds, like environmental disasters,
serious environmental pollution, failed reclamation, trafficking of radioactive
materials etc; at the same time, through the confirmed prescription of limita-
tions, it has the aim of simplifying life for companies and for those who carry
out controls of them with regard to crimes which are really formal crimes that
could be resolved with a more pragmatic approach.
The application of law 68 then poses a further question regarding the
actions of environmental agencies. There cannot be a system of controls or
authorizations under the same legislation which differs from region to region.
A concrete example: from the point of view of so-called fiscal control, up to a
couple of years ago the smoke emissions from the chimney of the incinerator
in Melfi was carried out every 3-4 years while, in the same period in Emilia
Romagna, the same structures were controlled at least 2 - 3 times a year. It is
not the same thing. I would like to be more precise: the risk in these cases is
not only of having, in the same country, some areas that are more polluted than
others, but also of creating real industrial dumping, in which a certain type of
industry would prefer to go to one area of the country as opposed to another.
I would like to conclude in the hope that the constitution of a police force
for the environment, born from the fusion of the State Forestry Department
and the Carabinieri Corps, can contribute significantly, not only to protecting
the common good of the environment but also to removing from the market
the many businesses that thrive on illegal actions, competing with honest, inno-
vative ones who place the environment at the heart of their activity.
