culture perceives this change. Ms Rossella Muroni, President of Legambiente,
reminded us that the law had been passed nearly one year ago and that in the first
eight months it was applied one thousand times, 950 times to be precise. This means
that the law is effective and went to respond a demand of legality.
Does this suffice? Not really, as Italy is full of laws that are approved and then
are not implemented. In this I must agree with Minister Costa: also simplification
is necessary. In the Campania Region, for example, every year, for the past ten years,
40,000 trials have lapsed by prescription. With regard to the functioning of justice
I would like to remind you what happened ten years ago. Initially, the crime of
bulky items dumping had been introduced: this was nonsense since starting a cri-
minal proceeding, with all its consequences in terms of work, resources, procedu-
res, time just because somebody had left a mattress or a bedside table on the street
was putting at risk the prosecution of more serious offences. It was like creating a
background noise which would cover very serious actions against environment and
territory. It was like a smokescreen behind which criminal affairs could be hidden.
Now we discuss the issue of controls. The reform of the environmental agen-
cies was an important step. Sometimes there is a form of negligence in politics, there
is a confused institutional system also as a result of the perfect bicameralism. In
summer 2013 in the Chamber of Deputies we passed the law for the reorganisation
of the agencies. The Senate took nearly two years to give the final approval with
some minor changes. The whole procedure is now completed and the law will finally
go to the Parliament. It is an important provision which gives citizens and enterpri-
ses some trust in the Institutions. The action of the agencies of control is funda-
mental, as is the presence, beside them, of an authoritative corps of the Police
Forces specialised in environmental matter, attentive to those issues, well established
in the territory, able to respond to a demand of credibility and security that citizens
require from public institutions. A way to implement that article of our Constitution
too often forgotten, I refer to article 54, in which it is stated that “discipline and
honour” are essential when the individual covers a position of public interest.
Controls are fundamental because legality is also the prerequisite for a
good economy: not only because “good economy” expels “bad economy”, but
because our economy has a lot to gain by raising the standards of legality.
